AGREEMENT LETTER BETWEEN

UBA â UMWELT BUNDES AMT
I.
Introduction
Soil and ground water contamination due to human activities constitute an
environmental and economic issue for most of Latin American countries, mainly on great
urban areas, intensive industrial production areas and natural resources exploitation sites.
Otherwise, it is possible to notice a lack of framing and information system models on the
matter, either in Spanish or Portuguese languages.
The Latin-American interchange of informations is still very poor, due to the lack of
developed specific and institutional frames, among other factors. On the other hand, in Latin
America there is a visible growing demand for specific technology, for technical and
management solutions, and for training programs.
In order to fill this lack of information up, and looking for proper responses to those
demands, it is being intended to create a âLatin-American Prevention and Control on Soil and
Ground Water Contamination Networkâ (Network), focused on dissemination of information
and comprehensive knowledge on soil and ground water contamination prevention, as well as
on management, recovery and redevelopment of contaminated sites (brownfields).
II.
Justification
In Brazil, CETESB, which legal duty is to prevent and control environmental pollution
in the domains of Sao Paulo State, has been going through an extensive qualification process,
enabling itself for the diagnosis and management of contaminated areas since 1993, when it
was established a technical co-operation agreement along with the German Government
through the Technical Co-operation Agency GTZ.

So far, a Contaminated Areas Management System for the State of Sao Paulo has been
set up and improved, and nowadays CETESB, having a well trained technical core team as
well as internal procedures and comprehensives guidelines established, is the main Brazilian
entity able to deal properly with the matter.
UBA is the central federal advisory authority on environmental protection in
Germany. Established 1974 as an independent federal authority the UBA has, among others,
the primary functions of providing scientific support for the federal government in matters
relating to emissions control, soil conservation, waste and water management and
environmental health issues.
Due to its nature as a governmental organization UBA is involved in many
international co-operations and programs in all fields of environmental protection.
Concerning contaminated land and brownfields, UBA was the co-ordinator and principal
contractor of the European Commission for the Concerted Action on Risk assessment for
Contaminated Land (CARACAS) from 1996 to 1998. The UBA was further one of the
participating scientific institutions of the subsequent EU Concerted Action CLARINET from
1998 to 2001 - co-ordinating the working group 1 on brownfield redevelopment. Currently
UBA chairs together with thee University of Nottingham from the United Kingdom the EU
brownfields network CABERNET. The results of the work of the UBA are published as
"Reports" (Berichte), "Materials" (Materialien), "Texts" (Texte), and in the "Environmental
Planning and Information System" (Umplis) and the "UNESCO Documents on Environmental
Education".
III.
The Parties
The following parties hereby enter into the present Co-operation Agreement:

AMBIENTAL, hereinafter CETESB, registered in CNPJ/MF under n.# 43.776.491/0001-70,
located in SĂŁo Paulo city, Brazil, represented by its President Director Mr. Otavio Okano and
its Engineering, Technology and Environmental Quality Director, Mr. Lineu JosĂŠ Bassoi, and

the UBA â UMWELT BUNDESAMT, hereinafter UBA, located in Dessau, Germany,
represented by its President Prof. Dr. Andreas Troge and its Soil Department Director and
Professor Dr. Volker Franzius.
The parties have decided to celebrate the present Co-operation Agreement, subject and
conditions as the following.
IV.
Purpose
To establish experiences and technical information interchange in order to make
possible the conception, framing and implementation of the âLatin-American Prevention and
Control on Soil and Ground Water Contamination Networkâ (Network).
The Network intends to stimulate and promote the production, dissemination and
interchange of knowledge, expertise and general and specific information on management and
redevelopment of contaminated sites (brownfields), as well as on prevention of soil and
ground water contamination.
V.
Expected Results
The parties are compromised on the accomplishment of several activities in order to
get the following results:
1. Development of Network Management Model;
2. Definition of Priority Thematic Areas;
3. Definition of Products and Services to be offered.
4. Framing of information systems for the building up of a Network Operation Platform;
5. Network Implementation.
Both sides are in the process of raising funds for the implementation of the here described
activities, amongst others with GTZ/German Federal Ministry for Economic Cooperation and
Development, and the German Federal Ministry for Education and Research.

VI. Entry into Force
The present Co-operation Agreement shall enter into force on the date of its signature
by the parties, and shall remain in effect for two years. An extension can be requested for two
years more under a signed Amendment.
This Agreement has been elaborated in both Portuguese and English languages,
however English shall bee the binding and controlling language for all matters relating to its
meaning and interpretation. Any communication between CETESB and UBA shall be in
English.
In Witness Whereof, the duly authorized Representatives sign this Co-operation Agreement in
two copies of equal content and validity, on dates and in places indicated below.
